PLEASE READ CAREFULLY. THESE TERMS AND CONDITIONS IMPOSE OBLIGATIONS AND RESTRICTIONS ON YOU. BY ACCESSING OR USING THIS SERVICE, “YOU” AS THE USER AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND BY ALL TERMS, POLICIES AND GUIDELINES INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS SERVICE.
These terms and conditions (“these Terms”) govern your use of the “Product Review” feature on gianttiger.com/tigregeant.com/Giant Tiger App (“this Service”) to submit and publish Content. This Service is provided to you by Giant Tiger Stores Limited (“Giant Tiger”).
“Content” means any comments, experiences, opinions, written expressions, photos, videos, product questions or answers or other information or data submitted and/or published by you to Giant Tiger with regards to any products or services sold or offered for sale by Giant Tiger. All Content must be truthful, accurate and represent your current honest opinion or experience.
GENERAL
By using this Service, you represent, warrant and covenant that you are of legal age of majority in your province or territory of residence, are lawfully able to accept these Terms and hereby accept to comply with these Terms. You are solely responsible for all access to and use of this Service including any breach of these Terms by you or any user of your device. For the purposes of these Terms, "you" means you and every person using this Service through your device. If you do not wish to be bound by these Terms, you must not access or use this Service. Giant Tiger may modify these Terms, including modification or termination of this Service or any components thereof, at any time without your consent or authorization and without notice.
PRIVACY
By accessing this Service and/or submitting or publishing Content, you acknowledge that you have reviewed and understand Giant Tiger’s Privacy Policy, and consent to the practices described in that policy (available at Privacy Policy - Giant Tiger as it may be updated from time to time).
USE OF CONTENT
Your Content will not be treated as confidential so do not submit any Content that you do not want to share with the public. Note that any Content published using this Service will feature your name as submitted. Any Content may or may not be used in Giant Tiger’s sole and absolute discretion. Giant Tiger reserves the right to delete, remove, or unpublish any Content, at any time and without notice, which wholly or partially: violates these Terms; is unclear; does not relate to the product being reviewed; is in a foreign language; references other companies or websites; includes unsolicited promotions or spam; or includes obvious errors.
ACCEPTABLE USE
You are responsible for your use of this Service. You shall not take any action that could harm Giant Tiger or anyone else, interfere with this Service, or use this Service in any manner that violates any law.
Without limiting the foregoing, you shall not: (i) engage in any use that would result in any illegal, unauthorized, abusive, annoying or offensive activities; (ii) make available offensive, defamatory, threatening, pornographic, morally offensive, racist, obscene, profane, or libelous content; (iii) commit or encourage an unlawful activity, a criminal offence, cyberbullying, stalking, harassment or any act that would give rise to civil liability; (iv) impersonate any person; (v) solicit, collect, transmit, store or otherwise make available private information or personal information of yourself or any third party; (vi) violate any laws which includes intellectual property or privacy laws, regulations or rights; (vii) hack, reverse engineer, disable, disrupt or interfere with the functioning of this Service; or (viii) use this Service in a manner that would serve to restrict or inhibit any other user from using or enjoying this Service.
LICENSE
For any Content, you grant to Giant Tiger a royalty-free, worldwide, irrevocable, transferable, perpetual license to use, adapt, republish, copy, translate or delete the Content, all of which without compensation to you. In the event any such Content should contain any feedback, Giant Tiger shall have a royalty-free, worldwide, irrevocable, perpetual license to use and incorporate any ideas, concepts, know-hows or techniques contained in the feedback for any purpose whatsoever including (without limitation) to develop, manufacture and market products incorporating such feedback. Such feedback will be deemed non-confidential information and Giant Tiger will be free to reproduce, use, disclose and distribute the feedback to others without limitation or compensation to you.
INDEMNITY
You agree to defend, indemnify and hold harmless Giant Tiger, its directors, officers, shareholders, employees, affiliates, agents, service providers and suppliers against any claims, damages, loss, harm, costs, liabilities and expenses (including reasonable lawyers’ fees) (collectively referred to as “Losses”) arising out of or in any way related to: (i) your access to and use of this Service, including any Content that you submit, publish, store or otherwise transmit on or through this Service; (ii) your conduct, your use or inability to use this Service; (iii) your breach or alleged breach of these Terms or of any representation, covenant or warranty contained herein; or (iv) your violation of any rights of any other person, conditions by you or any user of your device, or in connection with your or their use of this Service.
LIMITATION OF LIABILITY
Giant Tiger assumes no liability for your use of this Service, nor for any Content submitted, published, stored or uploaded by you or any third party. In the event of any breach by Giant Tiger of these Terms or any negligence by Giant Tiger, your sole and exclusive remedy shall be to terminate your use of this Service.
DISCLAIMERS
Giant Tiger does not guarantee the performance of this Service. Giant Tiger has no obligation to monitor this Service or the Content but Giant Tiger reserves the right to monitor this Service or the Content electronically from time to time and to disclose any information necessary to satisfy any laws, regulations or other governmental request or as necessary to operate this Service or to protect itself or others.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree that the courts of the Province of Ontario sitting in Ottawa shall have sole and exclusive jurisdiction over any action at law or in equity arising from your use of this Service and these Terms, and you irrevocably and unconditionally consent and submit to the sole and exclusive jurisdiction of such courts.
